  1. an actual communicant
  2. of 21 years of age or above
  3. persons who have their names entered on the church electoral roll
  4. free from any disqualification to serve.

The above requirements may be waived with permission of the bishop but such permission must be given each year before the election at the Annual Meeting of Parishioners (this does not apply to Guild Churches).

Those disqualified from holding office as Churchwarden are persons:

  1. disqualified from being a trustee of a charity as contained in the Charities act 1993 (and reproduced in Appendix III to the Church Representation Rules)
  2. convicted of an offence under Schedule 1 of the Children and Young Persons Act 1933
  3. disqualified by a bishop under Section 10(6) of the Incumbents (Vacation of Benefices) Measure 1977 (as amended).

A churchwarden may not be warden of more than one parish unless the parish belongs to the same benefice as the other parish, or belongs to a benefice held in plurality with the benefice to which the other parish belongs, or if the parishes share the same minister. No person may be appointed as warden of a Guild Church if they are churchwarden of a City parish or another Guild Church.
